No strike or lockout during a collective agreement
Workers can’t strike and employers can’t lock out workers while their collective agreement is in effect
Notice to bargain
OPSSU and OPSEU/SEFPO begin negotiating a renewal agreement and will set dates to advance our demands at the bargaining table.
Conciliation request
If negotiations break down, either party may ask the Ontario Labour Relations Board (OLRB) to appoint a conciliator to help reach a tentative collective agreement.
Role of the conciliator
The conciliator may either recommend that a Conciliation Board be appointed, or that no Conciliation Board be appointed referred to as a “No Board Report”
“No board report”
Either 9 days have elapsed from the report of a Conciliation Board, or 16 days have elapsed from the issuance of a “No Board Report”, the Parties are in a legal strike / lockout position.
Mandatory timelines
In order for either party to exercise their right to strike or lock out the collective agreement must have expired and the timelines outlined above have elapsed.
Strike vote
No employee may strike unless a strike vote has been taken either 30 days or less before the Collective Agreement expires, or the Collective Agreement expires with 50% or more voting in favour of a strike.
